General Terms and Conditions
§ 1 Scope
These terms apply to all sales of works by R.Thommen Photography under the Thommen Fine Art brand, unless otherwise agreed in writing.
§ 2 Prices & payment terms
All prices are in CHF and include packaging and delivery within Switzerland. For orders up to CHF 10’000, payment is due within 14 days. For Diamond works and orders over CHF 10’000, a deposit of 30% is due on ordering, with the balance due before delivery.
§ 3 Delivery
Delivery within Switzerland is included in the purchase price. International delivery is by arrangement; costs are agreed individually. Separate delivery terms apply to Diamond works.
§ 4 Cancellation & returns
An order becomes binding upon written confirmation. Cancellation is only possible if production of the work has not yet begun and Thommen Fine Art agrees to the cancellation in writing. There is no right of withdrawal for Diamond works.

§ 5 Authenticity & provenance
Each work is supplied with a certificate of authenticity and provenance documentation.
§ 6 Liability for defects
Obvious defects must be reported in writing within 3 days of delivery and documented with photographs. Where a complaint is justified, the work will be repaired, replaced or refunded.
§ 7 Copyright
The buyer acquires ownership of the physical artwork. All copyright and reproduction rights remain with Thommen Fine Art. Resale, for example through galleries or auctions, is permitted, including reproduction in catalogues.
§ 8 Jurisdiction
The place of jurisdiction is Chur, Switzerland. Swiss law applies exclusively.

Thommen Fine Art is a brand of R.Thommen Photography, a sole proprietorship owned by Remo Thommen. R.Thommen Photography is responsible for the processing of personal data on this website. 2. Enquiries and artwork details
When you make an enquiry, we process your first and last name, email address, any phone number you choose to provide, enquiry type and message. Enquiries sent from an artwork page also include the work title, work ID and work URL. The information is stored using Wix Forms and forwarded to the team handling your enquiry. It is used for advice, quotations, customer communication and, where applicable, order fulfilment. An artwork enquiry does not subscribe you to a newsletter.
3. Website operation and Wix
This website is operated using Wix.com Ltd., Israel. Wix provides hosting, forms, contact management and technical notifications. When you visit the website, Wix processes technical connection and usage data, including your IP address, browser and device information and pages visited, to deliver and secure the website and evaluate its operation.
4. Cookies and visitor statistics
The website uses Wix cookies for technical functionality and security. Wix Analytics provides visitor statistics, including sessions, devices and the origin of visits. Google Tag or Google Analytics, Google Tag Manager, Meta Pixel and TikTok Pixel are currently not connected to this website. You can delete or block cookies in your browser settings; this may limit website functionality.
5. Service providers and international processing
Wix and its subprocessors process data to provide the website and its functions. According to Wix, data is processed in Israel, Ireland and the United States, among other countries. Wix describes its service providers and safeguards in its privacy information. For an order, providers responsible for production, delivery or installation receive the information necessary for their respective tasks. Disclosures required by law remain possible.
6. Retention
Enquiry and contact data is retained for as long as needed to handle the enquiry, maintain the business relationship or protect legitimate claims. Statutory retention obligations remain applicable; business and accounting records subject to retention requirements are generally kept for ten years. You can request deletion using the contact address below.
7. Your rights
Within the scope of applicable data protection law, you can request access, correction and deletion of your data and, where applicable, restriction of processing or a copy of your data. Where processing relies on consent, you can withdraw that consent for the future. Please contact photo@remothommen.com. You can also contact the competent data protection supervisory authority; in Switzerland this is the Federal Data Protection and Information Commissioner (FDPIC).
8. Applicable data protection law
Swiss data protection law applies. Where other data protection rules, in particular the EU General Data Protection Regulation, apply to specific processing, those rules and the rights they provide remain unaffected.
